YEAR END SUCCESS STORY


The law firm has almost concluded the 2010 year with much success for its clients. We have personally tried in federal courts four trials in civil and criminal cases. In state courts, we have tried to verdict six trials before judges and juries. Before administrative judges, we have tried to verdict three cases. On appeal, we have received rulings and opinions from the Supreme Court of the United States, the Supreme Court of Tennessee, the United States Court of Appeals for the 6th Circuit; the Court of Criminal Appeals of Tennessee, the Court of Appeals of Tennessee and Chancery and Circuit Court from inferior courts. Additionally, we have resolved via mediation, negotiation and settlement more than one hundred civil and criminal cases very favorably for our clients. In the civil area of the law, our clients received as much compensation as policies of insurance provided in most cases, or settlements within the upper limits of estimated jury verdicts before suits were filed. In the criminal defense cases, not one client pled guilty to the original charge this year in state or federal court. That feat, in itself, is astonishing. Most of the negotiated plea agreements put the client in a great legal position. The best news is that many of the criminal defense section clients, who were the subject matter or target by law enforcement authorities, received very favorable closing letters advising no prosecution. As to the federal cases, several clients received less punishment than the government originally insisted at the time of indictment. The astonishing statistic for the firm and the client is that Mr. Bell, or a lawyer on his staff participated in more than 200 witness depositions in cases where the clients were seeking justice. Ms. Ledford estimates that Mr. Bell, Mr. Barnes, Mr. Holt, and Ms. Ham have examined more than 150 witnesses in criminal and civil trials this past year.  It is from those experiences and the history of being very serious litigating and advocating the clients legal issues that the moniker of the firm, “we are not paid to play” sums up the 2010 year in review.


Our in-house Senior Investigator Shayne Cooper was responsible for finding the key set of facts that often led to the successful results. Attorney John Barnes litigated and wrote many of the appeals for the clients. Mr. Barnes successfully appeared before several appellate courts, juries and administrative boards this past year obtaining great results. Attorney Ed Holt successfully represented many clients this year on behalf of the law firm, not only in Knox County, but also in other in state and out of state jurisdictions.  colleague and Of Counsel Paula Ham has litigated several jury trials with Mr. Bell in federal and state courts. Her presence as co-counsel with the firm has molded success story after success story. In sum, the Law Offices of James A.H. Bell, P.C. is very pleased to end the 2010 year with this work product. Mr. Bell was again recognized by his peers as a top attorney in criminal defense and civil litigator on the local, state and national level. This past year, Mr. Bell has lectured to law schools, local, state and national bar associations and groups from Las Vegas, New Orleans, as well as within the State of Tennessee.  Finally, we would be remiss not to give great credit to the paralegals and administrative staff of the law firm. Ms. Ledford and Ms. Smith attended and participated in virtually each criminal case in court. Ms. Wiser and Ms. Montgomery likewise participated in every civil case that was litigated.
